When a person passes away, in some instances a probate proceeding is required. The probate process is a court ordered process in which the court system oversees the overall administration and distribution of a deceased person’s estate. Probate is primarily a process through which title is transferred from the name of the deceased to the names of the beneficiaries.
With any court proceeding, certain forms, notice requirements, and other filings are necessary.
We are available to help guide an individual appointed, or seeking appointment as a Personal Representative to do the following:
- Filing of a petition with the proper probate court.
- Notice to heirs under the Will or to statutory heirs (if no Will exists).
- Petition to appoint Executor (in the case of a Will) or Administrator for the estate.
- Inventory and appraisal of estate assets by Executor/Administrator.
- Payment of estate debt to rightful creditors.
- Sale of estate assets.
- Final distribution of assets to heirs.
